User Agreement

1. Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you meet this requirement and that all information you provide is accurate and current.

2. The Service

EDMVocals.io provides AI-powered vocal generation tools that allow you to create original vocal audio files based on text lyrics and creative inputs. The Service is provided on a subscription basis, with a limited free tier.

3. Your Account

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree not to share your account with others or allow unauthorized access. Notify us immediately if you suspect unauthorized use of your account.

4. Ownership of Generated Content

You retain full ownership of all vocal audio files generated through your use of the Service (“Outputs”). You may use Outputs for any lawful purpose, including commercial use — including releasing music, licensing, sync, or any other professional application — without restriction or royalty owed to us.

The Company claims no ownership interest in your Outputs.

Note: AI-generated content may not be eligible for copyright protection under current law. We recommend consulting a legal professional if copyright ownership of your Outputs is material to your use case.

5. Subscriptions, Billing & Cancellation

• Paid plans are billed monthly and renew automatically until cancelled.
• You may cancel your subscription at any time through your account settings. Upon cancellation, you retain access to your current plan's benefits until the end of the current billing period.
• All sales are final. We do not issue refunds for any unused portion of a billing period or for any unused vocal credits.
• Unused credits from paid tiers carry over to the following month. Free tier credits reset each month and do not roll over.

6. Acceptable Use

You agree not to use the Service to:

• Clone, imitate, or impersonate the voice of any real, identifiable person or recording artist without their explicit written consent.
• Create content designed to deceive, defame, harass, or mislead others, including deepfakes or fraudulent audio.
• Generate content that is harmful, threatening, abusive, hateful, obscene, or otherwise objectionable.
• Resell, sublicense, or provide unauthorized third-party access to the Service or your account credits.
• Automate, scrape, or systematically access the Service through bots or scripts without our prior written permission.
• Violate any applicable local, state, national, or international law or regulation.

We reserve the right to suspend or permanently terminate accounts that violate these restrictions, without refund.

7. AI-Generated Content & Limitations

EDMVocals.io uses the ElevenLabs API to generate vocal audio. By using the Service, you acknowledge and accept the following:

• AI is not perfect. Generated vocals may contain errors, mispronunciations, skipped words, added sounds, or other unintended artifacts. Results are not guaranteed to match your input exactly.
• Results are inherently inconsistent. The same lyrics, settings, and parameters may produce meaningfully different Outputs each time. We cannot guarantee consistency across generations.
• Credits are consumed regardless of quality. Vocal credits are deducted at the time of generation. We do not issue refunds or credit adjustments for Outputs that do not meet your expectations, including cases where the AI makes mistakes or produces unexpected results.
• The underlying model may change. We may update or switch the AI model powering the Service at any time, which may affect the style, quality, or characteristics of Outputs.

We encourage you to treat each generation as an exploratory creative tool rather than a deterministic output. Regenerating with adjusted settings often yields improved results.

8. Third-Party Services

The Service relies on third-party providers, including ElevenLabs (AI audio generation), Stripe (payment processing), and Supabase (data storage). Your use of the Service is subject to their respective terms and privacy policies, in addition to this Agreement. We are not responsible for the actions or availability of these providers.

9. Our Intellectual Property

The Service, including its interface, design, software, and branding, is owned by Produce Smart LLC and protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service solely in accordance with this Agreement. Nothing in this Agreement transfers ownership of the Service or its underlying technology to you.

10. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any particular Output will meet your creative or commercial expectations.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Produce Smart LLC and its members, officers, and employees shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service. Our total cumulative liability to you for any claim arising under this Agreement shall not exceed the total amount you paid to us in the twelve (12) months preceding the claim.

12. Termination

We may suspend or terminate your access to the Service at our discretion, with or without notice, for conduct that we believe violates this Agreement or is harmful to other users, us, or third parties. Upon termination, your right to use the Service ends immediately and no refund will be issued for any remaining subscription period.

13. Changes to This Agreement

We may update this Agreement from time to time. When we do, we will revise the “Last updated” date at the top of this page. For material changes, we will make reasonable efforts to notify you (such as via email or an in-app notice). Your continued use of the Service after any update constitutes your acceptance of the revised Agreement.

14. Governing Law

This Agreement is governed by the laws of the State of California, without regard to its conflict of law provisions. Any legal action or proceeding arising under this Agreement shall be brought in the state or federal courts located in California, and you hereby consent to personal jurisdiction there.
